How Will I Be Paid?

The law firm of Manuel Gonzales, P.C., can push your claim through the workers' compensation system. The process can be frustrating, and we encourage our clients to stick with it. We are with you every step of the way as we seek one of the four levels of income for you:

  • Temporary income benefits (TIBs): Temporary income benefits consist of 70 percent of your average weekly wage. This includes your gross income earnings, any overtime pay, bonuses or monetary contributions made by your employer on your behalf prior to the injury that it is no longer contributing. It will be calculated using your pay within 13 weeks prior to the injury. You are entitled to receive temporary income benefits for two years or until you reach your clinical maximum medical improvement (MMI) or released to work full duty by a doctor or have returned to work making your pre-injury wages.
  • Impairment income benefits (IIBs): Impairment income benefits consist of 70 percent of your average weekly wage. When you reach MMI, it will be determined if you have any permanent physical damage. If this is determined, you will receive an impairment rating. Each impairment rating percentage allows you three weeks of IIB payment.
  • Supplemental income benefits (SIBs): Supplemental income benefits consist of 80 percent of the difference between 80 percent of your average weekly wage and your weekly wages after the work injury. These benefits are paid after your IIBs have ended if you received an impairment rating of 15% or higher.
  • Lifetime income benefits (LIBs): Lifetime income benefits are paid when a worker sustains a specific type of injury under the Texas Labor Code. Please call our office to find out if you qualify for LIBs.
